Guest Wi-Fi Terms of Use

These terms govern the free guest wireless internet service (“Guest Wi-Fi” or the “Service”) offered by Elevated Hospitality Group LLC (“we,” “us,” or “our”) at The Rose and Club Torch, 2120 4th Avenue, Rock Island, Illinois 61201. Club Torch is a brand of The Rose operated by the same company at the same address; one Guest Wi-Fi network serves the whole building and these terms apply whichever name brought you to us.

By accepting these terms on the Wi-Fi sign-in page, or by connecting to and using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not connect.

1. The Service

Guest Wi-Fi is a free courtesy offered to guests while they are on our premises. It is provided “as is” and “as available” with no promise of availability, coverage, speed, reliability or security. We may, at any time and without notice: limit bandwidth or session length; block, filter or throttle particular content, sites, ports, protocols or services; disconnect any device; or suspend, change or discontinue the Service. You have no right to any particular level of service and the Service is not intended for business-critical or emergency use.

2. This Is Not a Secure Network

Guest Wi-Fi is a shared public network. Information you send over it may be visible to other users or to third parties. Do not transmit passwords, payment details, or other sensitive information unless the website or app you are using encrypts the connection (for example HTTPS or a VPN). You are solely responsible for the security of your own device, including its firewall, updates and anti-malware protection, and for any data you choose to send or receive.

3. Acceptable Use

You agree that you will not use the Service to:

  • violate any federal, state or local law or regulation;
  • access, transmit, store or distribute material that is unlawful, obscene, threatening, harassing, defamatory, or that infringes any copyright, trademark or other right, including unauthorized downloading or peer-to-peer sharing of copyrighted works;
  • send unsolicited bulk email or messages (spam), or phishing or fraudulent content;
  • attack, scan, probe, monitor, intercept, overload or interfere with this network, any device on it, our systems, or any other network or user, or attempt to gain unauthorized access to any of them;
  • distribute viruses, malware or other harmful code;
  • impersonate any person or misrepresent your affiliation;
  • set up your own access point, extender or bridge on the network, or resell, share or otherwise redistribute the Service; or
  • use the Service in any way that degrades it for other guests.

We may disconnect or block any device that violates these rules or that we reasonably believe is harming the network or others, and we may refer unlawful activity to law enforcement.

4. Information We Collect When You Connect

To operate, secure and troubleshoot the Service we automatically record technical connection data, which may include:

  • your device’s hardware (MAC) address, device type and device name;
  • the IP address assigned to your device;
  • the date, time and duration of each connection and the amount of data used;
  • the fact that these terms were accepted, and when; and
  • network-level traffic information (such as the domains or services your device connects to) as needed for security filtering and abuse prevention.

We do not require your name, email address or telephone number to use Guest Wi-Fi, and we do not read the content of your encrypted communications. If we ever offer an optional sign-in with an email address or phone number, we will tell you at that time what it is for, and any marketing consent will be collected separately as described in our Messaging Terms.

We do not sell this information and we do not share it with third parties or affiliates for marketing or promotional purposes. We may share it with the service providers that supply and support our network equipment and internet service, solely so they can provide those services to us, and as described in Section 5. We retain connection logs only as long as reasonably necessary for security, troubleshooting, abuse investigation and legal obligations, and then delete them. The rest of our Privacy Policy applies to this data.

5. Disclosure to Law Enforcement

We may disclose connection records where reasonably necessary to comply with applicable law; to respond to a subpoena, court order, warrant or other valid legal process; to respond to lawful requests from governmental or law-enforcement authorities; to investigate misuse, fraud or a security incident; to enforce these terms; or to protect the rights, property or safety of our guests, staff, business or others.

6. Third-Party Content

The Service gives you access to the internet. We do not control and are not responsible for any website, app, content or service you reach through it, and we do not endorse any of them. Your dealings with third parties, including any purchases, are solely between you and them.

7. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Service, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, Elevated Hospitality Group LLC, The Rose, Club Torch, and their owners, members, managers, employees, contractors and service providers will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or for any loss of data, loss of profits, damage to or infection of your device, interception or misuse of your information by third parties, or any interruption of the Service, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Your sole remedy for any dissatisfaction with the Service is to stop using it. Nothing in these terms limits liability that cannot be limited under applicable law.

9. Indemnity

You agree to indemnify and hold harmless Elevated Hospitality Group LLC and the persons listed in Section 8 from any claim, loss, liability or expense, including reasonable attorneys’ fees, arising from your violation of these terms or of any law while using the Service.

10. Age and Premises

The Rose and Club Torch serve alcohol and are age-restricted. The Service is intended for guests lawfully present on our premises during our operating hours and for private-event guests during their event. It is not directed to children, and we do not knowingly collect personal information from children under 13 through the Service.

11. Changes and Termination

We may change these terms at any time. The version presented on the Wi-Fi sign-in page when you connect, or published at this address, is the version that applies to that session. We may terminate your access to the Service at any time for any reason.

12. Governing Law

These terms are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law principles. Any dispute arising from the Service will be brought in the state or federal courts located in Rock Island County, Illinois, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect.
